Terms & Conditions
The following terms and conditions apply to all development, design, marketing, consulting, and technology services provided by Svayambhutech (“Svayambhutech”, “we”, “us”) to the Client (“you”, “Client”). Please read these terms carefully. By purchasing or using our services, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.

Svayambhutech offers services across the following domains:
- Web Development
- Mobile Application
- Development
- UI/UX Design

2. Acceptance of Terms
It is not mandatory for the Client to sign a physical or digital acceptance of these terms for them to apply.
Acceptance of a quotation, proposal, invoice, or advance payment will be deemed as full acceptance of these Terms & Conditions.
3. Engagement Models
Svayambhutech follows multiple engagement models based on project requirements:
a. Hire Dedicated Resources
Best suited for medium to large-scale projects with long-term engagement.
b. Fixed Price Model
Ideal for startups and small businesses where scope, timeline, and cost can be defined upfront.
c. Time & Material Model
Clients pay based on actual time and resources utilized for the project.
d. Bucket Model
A flexible option for small or evolving projects, where predefined hours (10, 20, 40, etc.) are purchased and consumed as tasks are completed within the agreed timeline.
4. Quality of Service
Svayambhutech is committed to delivering high-quality services within agreed timelines.
While we strive to exceed expectations, delivery timelines may vary based on dependencies such as client inputs, third-party services, or scope changes.

6. Client Responsibilities
To ensure smooth project execution, the Client agrees to:
- Provide clear and complete requirements
- Share timely inputs, feedback, and approvals
- Be available for scheduled meetings and demos
- Raise any dissatisfaction promptly, allowing us to address concerns early
Delays in client responses may result in extended timelines and additional costs.
7. What We Will Not Do
Svayambhutech will not:
- Breach project confidentiality
- Work directly on live servers unless explicitly agreed
- Be responsible for production data without test/staging access
- Tolerate abusive or disrespectful behavior toward team members
8. Invoicing & Payments
- Advance payment or first invoice clearance confirms acceptance of these terms
- Invoices are issued prior to commencement of work
- Payments must be made in the currency mentioned on the invoice
- Outstanding invoices may result in temporary project suspension
- Prices are exclusive of applicable taxes unless stated otherwise
Billing Structure:
- Hourly/Daily: Based on an 8-hour working day
- Weekly: 5 working days per week
- Bucket Hours: Must be consumed within the agreed validity period
9. Limitation of Liability
Svayambhutech shall not be liable for indirect, incidental, or consequential damages, including loss of revenue, profit, or business opportunities, except in cases of proven negligence or breach.
10. Disclaimer of Warranties
Svayambhutech does not guarantee business outcomes such as increased sales, traffic, rankings, or revenue.
Deliverables are created based on best practices and client specifications, but results may vary.
11. Design & Development Credit
Unless otherwise agreed, Svayambhutech may include a small credit link or reference on delivered digital assets and may showcase the work in its portfolio.
12. Use of Project Management Tools
Svayambhutech may provide temporary access to internal project management tools for collaboration purposes.
- Access credentials must be kept confidential
- Svayambhutech may suspend or modify tool access without notice
- We are not responsible for technical outages, security issues, or data loss related to third-party tools
13. Intellectual Property Rights
Each party retains ownership of their existing intellectual property.
Any newly developed IP will be governed by the agreed contract terms or proposal.
14. Issue Resolution
If you are dissatisfied with any service:
- Raise concerns with the assigned developer/designer
- Escalate to the project manager if needed
- Billing-related issues should be raised with our accounts team
15. No Derogatory Comments
Clients must not post defamatory or damaging remarks about Svayambhutech publicly.
Concerns should be addressed through official communication channels.
16. Non-Compete Clause
During the engagement, the Client agrees not to directly or indirectly solicit, hire, or engage Svayambhutech employees or contractors.
17. Entire Agreement
These Terms & Conditions constitute the complete agreement between Svayambhutech and the Client and supersede any prior discussions or agreements.
18. Copyright & Ownership
All materials, content, and intellectual property created by Svayambhutech are protected under applicable copyright laws unless otherwise agreed in writing.
19. Refund Policy
Refunds are processed only under exceptional circumstances after a thorough internal review.
Refund Eligibility:
- Work has not commenced
- Issue is beyond feasible resolution
- Payment terms have not been violated
- No commercial use of delivered assets
- Valid documentation and proof provided
- Refund decisions are final and non-reversible.
Refund Process:
- Evaluation and verification
- Agreement signing
- Refund processing within 7–10 business days
- Refunds processed in the original payment currency

Svayambhutech reserves the right to update these Terms & Conditions at any time without prior notice.
